The
Political System of Mauritius
The
Republic of Mauritius is a sovereign and democratic State within the British Commonwealth.
Its Constitution clearly spells out the respective powers of the legislative, of the
executive and of the judiciary, and it provides guarantees to each Mauritian citizen in
terms of basic civil rights such as freedom of association, of opinion and of speech,
freedom of religious belief and practice, and the right to private property.
The Head of State is the President of the Republic, who is elected by the National
Assembly. The President appoints as Prime Minister the leader of the party having won a
majority in the National Assembly, following elections held every five years.
The Prime Minister in turn chooses his Ministers from among the members of the National
Assembly. He is the Head of the Government and chairs meetings of the Cabinet, which holds
a collective responsibility vis-a-vis the National Assembly. The elected representatives
of the people vote new legislation, discuss current Government matters, and keep control
over public finance managed by the Executive. Bills are presented, discussed about and
voted by the National Assembly. New legislation comes into force after its promulgation by
the President.
The right to vote, by secret ballot, is granted to all Mauritian citizens aged 18 and
above. 62 elected members of the National Assembly represent the 21 constituencies of
Mauritius and Rodrigues. 8 other members of the Assembly are nominated by way of a best
loser system which aims at maintaining fair representation of the ethnic groups and of the
political forces of the island.
The Constitution also provides for the appointment, by the President, of the Leader of the
Opposition. He can either be the leader of the largest opposition party, or the person in
a position to rally the support of the opposition parties represented at the National
Assembly. He enjoys an official status, and he must be consulted by the Prime Minister for
certain types of appointments within the public sector.
